1.1Please read these Terms of Service carefully before using theyachtweek.com (the Site), the Yacht Week app (the Application), and the services made available through them.
1.2The Site and the Application are operated by Day 8 AB, a company registered in Sweden with organisation number 556765-8769 and registered address at Beckholmsvägen 4, 115 21 Stockholm, Sweden, trading as Yacht Week. References to we, us and our are to Day 8 AB.

1.4These Terms of Service cover your use of the Site and the Application. They do not govern a booking. If you book with us, your booking is governed by our Package Booking Terms and Conditions, which are published separately. Where the two differ in relation to a booking, the Package Booking Terms and Conditions apply.
1.5We may change these Terms of Service from time to time. The version published at the time you use the Site is the version that applies, and we will update the date at the top of this page when we make a change.
2.1You are responsible for all access to the Site using your internet connection, even if the access is by another person.
2.2We may restrict your access to the Site or part of it. Access to restricted areas may be subject to registration and other conditions. Where we grant permission to access a restricted area, we may withdraw that permission at any time, including where you breach these Terms of Service.
2.3Your permission to use the Site is personal to you and non-transferable, and you may not use the Site for commercial purposes.
3.1We will use reasonable efforts to keep the Site available at all times. We cannot guarantee that the Site, or any function or feature of it, will always be available or free from error. In particular the Site may be unavailable while we carry out upgrades or essential maintenance.
4.1The information and prices shown on the Site are updated from time to time and may have changed by the time you come to book.
4.2We make every effort to ensure the accuracy of that information, but errors do occasionally occur. You must check all the details of your booking, including the price, at the time of booking.
4.3Where a pricing error is identified after a booking is confirmed, our Package Booking Terms and Conditions set out what happens next.
5.1The intellectual property rights in the Site and in all text, pictures, video and other content made available on it are owned by us or our licensors.
5.2You may view and print content from the Site for your own personal, non-commercial use. You may not otherwise copy, reproduce, distribute, modify or commercially exploit any part of the Site without our prior written consent.
6.1Your use of the Site is conditional on your compliance with these rules. You must not:
6.2We grant the operators of public online search engines limited permission to use search retrieval applications to reproduce material from the Site, solely to the extent necessary to create publicly available searchable indices of that material in connection with their public search service. We may revoke this permission generally or in specific cases.
7.1Where the Site allows you to submit content, you confirm that the content is yours to submit and does not infringe anyone else's rights.
7.2You must not submit content that is unlawful, defamatory, obscene, threatening, discriminatory, or likely to harass or distress another person.
7.3You grant us a non-exclusive, worldwide, royalty-free licence to use, store, reproduce and display that content in connection with operating and promoting the Site. You keep ownership of your content.
7.4We may remove content submitted through the Site at our discretion, including where it breaches these Terms of Service.
8.1The Site may link to, or frame material from, other websites and online resources that we do not control and do not endorse. We have not verified the accuracy of that material and make no representation or warranty about it.
8.2Your use of third-party websites and resources is at your own risk, and the terms and privacy information of that third party apply.
9.1How we handle personal data is set out in our Privacy Policy, published on the Site.
9.2We use cookies and similar technologies. Details are set out in our Cookie Policy, published on the Site.
10.1This section is the general waiver referred to in our Package Booking Terms and Conditions.
10.2Our events take place on and around water, and include sailing, swimming, boarding and disembarking yachts, tenders and water taxis, and social events on and off the water. Activities of this kind carry a degree of inherent risk that cannot be removed entirely, however carefully they are run.
10.3By booking with us and by participating in our events, you acknowledge those inherent risks and accept that you participate voluntarily. You are responsible for your own conduct, for acting sensibly in relation to your own safety and that of others, and for following the safety briefings and reasonable instructions given by your skipper, your host and our Event Team.
10.4You confirm that you are in sufficient health to participate, and that you have told us about any medical condition, mobility issue or disability that may affect your participation, as set out in the Package Booking Terms and Conditions.
10.5It is a condition of travelling with us that you hold suitable travel insurance covering the activities you intend to take part in, including sailing.
10.6Nothing in this section excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited by law. Nothing in this section affects our responsibility as package organiser for the proper performance of the travel services included in your package, which is set out in the Package Booking Terms and Conditions.
11.1We provide the Site on an "as is" basis and make no representations as to the quality, completeness or accuracy of content made available on it. To the maximum extent permitted by law we exclude all conditions, warranties and other terms that might otherwise be implied by law into these Terms of Service.
11.2We are not liable for loss or damage caused by a virus or other technologically harmful material that may infect your device as a result of using the Site, or by any content on a third-party site we link to.
11.3We are not liable for business losses. If you use the Site for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.
11.4Nothing in these Terms of Service excludes or limits our liability for death or personal injury resulting from our negligence or that of our employees or agents, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited by law. Nothing in these Terms of Service affects your rights as a consumer or any other statutory rights which cannot be excluded.
11.5Our liability in connection with a booking is set out in the Package Booking Terms and Conditions and is not limited by this section.
12.1These Terms of Service are governed by the laws of Sweden. The courts of Sweden shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms of Service or their subject matter or formation, including non-contractual disputes and claims.
12.2This does not affect any right you may have as a consumer under mandatory law to bring proceedings in the courts of the country in which you are domiciled, or to rely on mandatory consumer protection rules of that country.
